These Terms & Conditions (the "Terms") apply when you use store.micro-swiss.com (the "Site") or buy products directly from Microswiss LLC ("Micro Swiss," "we," "us," or "our").
By using the Site, creating an account, or placing an order, you agree to these Terms and the policies linked on the Site, including our Privacy Policy and Returns & Refund Policy. If you buy for a business, you confirm that you have authority to accept these Terms for that business.
These Terms do not take away consumer rights that cannot legally be waived. If mandatory law conflicts with these Terms, that law controls.
Accounts and eligibility
You must be legally able to enter into a contract where you live. If you create an account, give us accurate information, protect your password, and tell us promptly about unauthorized use. We may verify, suspend, or close an account to prevent fraud, protect the Site, comply with law, or enforce these Terms.
Products and Site information
We try to keep product descriptions, images, prices, inventory, specifications, and compatibility information accurate. Errors or changes may occur, and images or colors may look different on your device. We may correct errors, update information, limit quantities, or discontinue products or Site features at any time.
Before buying or installing a product, review its current product page, specifications, compatibility notes, instructions, and warranty. References to third-party printer brands or models describe compatibility only; they do not imply sponsorship or affiliation unless we say so. Printer modifications or manufacturer design changes may affect fit or performance.
Orders, prices, and payment
Your order is an offer to buy. An automated confirmation means we received it, not that we accepted it. We generally accept an order when we send a shipment confirmation. Before acceptance, we may verify payment, identity, address, inventory, quantity, or other order details.
We may refuse, limit, or cancel an order for a legitimate reason, including payment failure, suspected fraud, pricing or inventory errors, export restrictions, or unusually large quantities. If we cancel after charging you, we will refund the canceled amount.
Prices may change without notice. The price at checkout applies, subject to correction of obvious errors. You authorize us and our payment providers to charge the payment method you submit. Shipping, taxes, duties, and other charges are shown at checkout when our system can calculate them. Promotions and discount codes are subject to the terms shown with the offer and generally cannot be combined or applied after purchase.
Shipping and international orders
Shipping options, costs, and estimated delivery times appear at checkout. Processing and delivery dates are estimates unless we expressly guarantee them. Give us a complete, correct delivery address. If a package is returned because of an incorrect address, refusal, or failed delivery attempts, we may charge the actual cost to resend it or deduct permitted shipping and handling costs from a refund.
Risk of loss passes to you when the order is delivered to the address or authorized recipient you selected, unless applicable law says otherwise. Contact us promptly about a delayed, lost, stolen, or damaged package and keep the packaging and tracking information.
For international orders, you are responsible for import duties, taxes, brokerage fees, permits, and legal import requirements not collected at checkout. We may refuse or cancel shipments that would violate export controls, sanctions, carrier rules, or other law.
Cancellations, returns, and refunds
Our current Returns & Refund Policy, linked on the Site, controls return eligibility, authorization, condition requirements, shipping costs, refunds, replacements, and any applicable consumer withdrawal rights. As of the effective date above, eligible returns or replacements generally must be requested within 30 days of purchase. Do not send a product back before receiving authorization and instructions.
If you bought from a reseller or another seller, request the refund from that seller. A separate Micro Swiss product warranty may still apply. Refunds are generally sent to the original payment method after any required inspection. Mandatory consumer rights remain available.
Product warranties
A product is covered only by the express warranty, if any, shown on its product page, packaging, instructions, or separate Micro Swiss warranty policy, plus any warranty rights that cannot legally be excluded. Warranty terms and duration may vary by product.
We may require proof of purchase, photos, troubleshooting information, inspection, or return of the product. Unless a warranty says otherwise, it does not cover ordinary wear, clogs, incorrect installation, incompatible parts or materials, use outside published limits, misuse, neglect, accidents, unauthorized repairs or modifications, or damage caused by other equipment. These exclusions apply only where permitted by law.
Installation and safety
3D-printer components can involve high temperatures, electricity, moving parts, firmware, and mechanical alignment. Incorrect selection, installation, configuration, or use can damage equipment or cause burns, fire, electric shock, fumes, or other injury.
Use the correct product for your printer and follow current Micro Swiss and printer-manufacturer instructions and warnings. At a minimum:
· disconnect power and let hot parts cool before installation or service;
· confirm voltage, heater, sensor, connector, wiring, and firmware settings before powering the printer;
· test temperature control and thermal-runaway protection after installation; and
· stop using the product if you see damaged wiring, unstable temperature, smoke, unusual odor, looseness, or another unsafe condition.
Use a qualified technician if you cannot perform the work safely. Our instructions and support information do not replace professional judgment or the safety requirements for your complete printer system.
Acceptable use of the Site
Use the Site only for lawful purposes. You may not commit fraud; violate another person's rights; submit unlawful or abusive material; transmit malware; interfere with security or operation; scrape or copy Site data through unauthorized automated means; impersonate others; spam or phish; or commercially exploit the Site or its content without permission.
We may investigate violations and restrict or end access when reasonably necessary. The Site may sometimes be unavailable or contain errors, and we do not guarantee uninterrupted access.
Intellectual property and submissions
The Site and its text, logos, images, videos, drawings, CAD files, manuals, software, and other content are owned by or licensed to Micro Swiss and protected by intellectual-property laws. You may use materials we provide for lawful personal use, product evaluation, installation, and maintenance. You may not publish, sell, license, modify, or commercially exploit them without our written permission, except as allowed by law.
If you submit a review, photo, video, suggestion, or other content, you keep your ownership rights but give Micro Swiss a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and display it for our products, services, Site, support, and marketing. You confirm that you have the right to submit it and that it is lawful and accurate. Do not submit confidential material.
Third-party services, privacy, and messages
The Site may use or link to third-party services such as payment processors, carriers, videos, reviews, social networks, or analytics providers. Their own terms and privacy notices may apply. We do not control those services and, to the extent permitted by law, are not responsible for their content, security, availability, or transactions.
Our Privacy Policy explains how we handle personal information. We may send order confirmations, receipts, shipping notices, account alerts, and other service messages electronically. You may unsubscribe from marketing messages, but you will still receive necessary order and service communications.
Disclaimers
To the maximum extent permitted by law, the site and online services are provided "as is" and "as available." We do not promise that they will always be available, secure, accurate, or error-free, and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Products remain subject to any express Micro Swiss warranty and any warranty or consumer right that cannot legally be excluded.
Limitation of liability
To the maximum extent permitted by law, Micro Swiss and its affiliates, officers, employees, agents, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, or for lost profits, revenue, business, opportunity, goodwill, or data, arising from the site, an order, or a product.
To the maximum extent permitted by law, Micro Swiss's total liability will not exceed the amount you paid for the product or order that caused the claim. For a claim unrelated to a purchase, the limit is US $100.
These limits do not apply where liability cannot legally be limited, including certain claims involving fraud, willful misconduct, death, personal injury, mandatory product-liability law, or non-waivable consumer rights. Some jurisdictions may not allow all of these limits.
Indemnity and events beyond our control
To the extent permitted by law, you will protect and reimburse Micro Swiss against third-party claims and reasonable costs caused by your unlawful misuse of the Site, material breach of these Terms, submitted content, or violation of another person's rights. This does not apply to the extent a claim was caused by Micro Swiss or where consumer law prohibits it.
We are not responsible for delay or failure caused by events beyond our reasonable control, such as severe weather, natural disasters, war, labor disputes, carrier or supply interruptions, utility failures, cyberattacks, government action, or import/export restrictions. Mandatory rights for delayed or unperformed orders still apply.
Governing law and general terms
Please contact us before filing a formal claim so we can try to resolve the issue. These Terms are governed by Minnesota law, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Unless mandatory law allows you to file elsewhere, disputes must be brought in the state courts in Anoka County, Minnesota, or the federal courts in the District of Minnesota. Consumers keep any non-waivable protections and forum rights provided by the law where they live.
These Terms, together with the policies and product-specific terms linked or presented at purchase, are the agreement between you and Micro Swiss for the Site and direct online purchases. If one provision is unenforceable, the rest remain effective. A failure to enforce a provision is not a waiver.
Changes to these Terms
We may update these Terms by posting a revised version and changing the effective date. We will provide any additional notice required by law. Changes apply going forward and do not change an already accepted order unless required by law or agreed by both parties. Continued use of the Site after the new effective date means you accept the revised Terms.
